– DESIGNS

No matter the business you are in, there comes a time that you will discover that your successful products are being copied by competitors.

Nevertheless, creativity pays off because this is the only way to bring your products to a higher level and to attract buyers. The efforts and investments that are involved are not minor . Therefore, you want your creations to be adequately protected.

That is exactly what a design registration stands for.

Individual character

It ensures that the outer appearance of a new product, having an individual character, gets the protection that it deserves.

In the design registration the external features that characterize the design are illustrated in detail by means of photographs or line drawings.

It gives you the exclusive right, a monopoly on the use of the design. That way your design is safeguarded and you will always be ahead of potential infringers. By using the D symbol on your creation you explicitly claim to be the proprietor of the design.

Protect your creations

Designs are 3D creations. They can be found in all industries and for very diverse products such as clothing, footwear, jewellery, domestic appliances, light fittings, furniture, packagings, vehicles, candy, perfume bottles, etc.

A 2D creation can be protected as well, but then it is called a “drawing”. Think about prints on textile, the pattern on wall paper, graphical symbols, etc.

In the BCIP (Benelux Convention on Intellectual Property) you can find the legal provisions for the protection of designs and drawings. This is, however, a complex issue and not easy to deal with by yourself.

We will be happy to examine with you the possibilities of protecting your design or drawing and, later on, you can still rely on us for advice and assistance.
