– TRADEMARKS
Whatever you do or wherever you look, you are surrounded by trademarks. Few give it a thought, but they are a recurrent and connecting theme in our daily life as consumers.
They constantly define what we like and dislike in the huge offering of goods and services and so they influence the choices we make.
Sometimes, trademarks leave a lasting impression that will determine our buying behaviour for many years.
Distinctivity
The trademark’s most important function is to “distinguish”. This means that it should allow a consumer to recognize a product/service and to link it to a specific undertaking.
Once a trademark is appreciated by the public it is soon considered as a sign that guarantees the good quality of a product or a service and, this is also how it lives on in the mind of a consumer.
For companies, trademarks are an instrument to build their proper identity which they want to preserve at all times. However, the exclusive right to a trademark can only be claimed if you have a registration. Mere use never can give you a monopoly. Therefore, it is not surprising that entrepreneurs are more and more convinced of the importance of the ® certificate.

By the way
By the way, did you know that not only names and logos can be registered as a trademark, but also packagings, labels, slogans, shapes, colours, sounds (e.g. publicity jingles) and even smells?
Registering a trade name as a trademark is also a good move. This way, its scope of protection will become much broader and if you want to expand your activities later on, you will not risk unpleasant surprises.
Obviously, not everything can be registered as a trademark. Moreover, each country has its own specific trademark law. In the Benelux this is the BCIP (Benelux Convention on Intellectual Property). No easy matter, but we will be happy to help and advise you in order to guide you smoothly through the registration procedure.
